Terms and Conditions

These Terms and Conditions ("Terms") form the master agreement between Vinci STEAM Educations LLC ("Vinci", "we", "our") and each student, parent/guardian, or customer (collectively, "Participant"). By enrolling in or attending any Vinci class/course, program, activity, service, or event (collectively, the "Services"), you acknowledge and agree to these Terms and to the separate incorporated documents listed below.

 

1. Incorporated Documents (Binding by Reference)

The following companion documents are integral parts of these Terms and are incorporated herein by reference. Each contains additional obligations that apply to your participation:

In the event of any conflict: (a) Mandatory legal notices in the Liability Waiver control for risk, injury, medical, indemnity, and release matters; (b) The Privacy Policy controls for data, communications, media, and image use; (c) Rules and Regulation controls for conduct standards; and (d) These Terms control for commercial, payment, enrollment, and termination items.

2. Program Changes & Cancellations

  1. Vinci may cancel or reschedule any class, program, activity, or event for low enrollment, staffing constraints, facility issues, safety, severe weather, governmental order, or other reasonable cause.

  2. Vinci may similarly suspend or terminate in-progress activities where safety, operational, or compliance concerns arise.

3. Cancellation & Refunds

Refund, credit, transfer, and withdrawal conditions are defined in the specific Cancellation Policy applicable to each Service (published in the Service description or enrollment materials). Different Services may have different policies. Processing or administrative fees (if any) are as stated in the applicable policy.

4. Withdrawals & Administrative Fees

An administrative and/or processing fee per student will apply to participant‑initiated withdrawals as detailed in the relevant Cancellation Policy.

 

5. Returned / Invalid Payments

A bank processing charge of thirty‑five dollars (US $35) will be assessed for any returned, reversed, or dishonored payment instrument (including ACH, check, or comparable transaction). Replacement payment must be received promptly to retain enrollment.

 

6. Make-Up Classes

Students who are absent may request up to two (2) make-up classes within one (1) week of the original absence, subject to instructor availability and space capacity. Parents must submit a leave request form as specified in the Rules and Regulation (Parent Regulations). Make-up classes are a courtesy, not a guaranteed entitlement. No refunds or credits will be issued for make-up sessions that cannot be scheduled within the one-week window.

7. Mandatory Emergency Contact & Health Form

Completion of the Vinci Emergency Contact & Health Form is REQUIRED for each enrolled student. The form (https://www.vincisteam.com/studentinfocollection) must be submitted no later than 48 hours before the first class/session starts (or immediately upon late enrollment). A student may be withheld from participation (without refund for missed time) until a materially complete form is received and processed.

Data Categories & Limited Use: See the Privacy Policy (Student Information & Health Collection) for required information categories, limited safety/emergency use, and handling safeguards.

Duty to Update: You must promptly update Vinci in writing (email to info@vincisteam.com) if any material health, allergy, emergency contact, or pick‑up authorization information changes. Outdated information may increase risk; failure to update is deemed an assumption of any incremental risk arising from stale or omitted data.

Medication & Equipment: You are responsible for providing any necessary labeled emergency medication or devices (e.g., EpiPen, inhaler) and ensuring the student understands permitted self‑carry policies where allowed. If a required item is not supplied, Vinci may (at its discretion) restrict participation in higher‑risk activities.

False, incomplete, or omitted disclosures that materially impact safety may result in suspension or dismissal consistent with Section "Disruptive or Unsafe Conduct" and may void certain portions of risk allocation relied upon in the Liability Waiver to the extent permitted by law.

8. Risk, Assumption, Release, Medical & Indemnity (Summary Reference Only)

All risk assumption, releases of claims, emergency medical authorization, and indemnity obligations are fully stated in and governed by Liability Waiver and Release of Claims. This section is a non‑exhaustive summary only and does not limit the broader language of the Liability Waiver.

9. Conduct, Safety & Use of Facilities

Participant conduct (including behavior of parents/guardians and guests), standards of classroom interaction, equipment usage, safety expectations, attendance, parking, and disciplinary processes are governed by the "Rules and Regulation" document. You are responsible for reviewing and ensuring compliance with all Student Rules, Parent Regulations, and Facility Usage Rules before participation and on an ongoing basis.

10. Damages & Property Responsibility

Financial responsibility for damage, loss, misuse, vandalism, unauthorized removal, or improper operation of Vinci property, facilities, tools, equipment, robots, parts, materials, or technology is governed by the Rules and Regulation and Liability Waiver documents. You agree to promptly reimburse Vinci consistent with those documents.

11. Communications, Personal Data & Email Use

Collection, storage, permitted uses, and disclosures of personal data (including email addresses and other contact details) are governed exclusively by the current Privacy Policy. Operational notices, service announcements, safety messages, and essential transactional communications may be sent even if marketing preferences are limited, as allowed by law and the Privacy Policy.

12. Photo, Video & Media Materials

Media capture (still images, audio, video), permitted uses, opt‑in/opt‑out processes, removal requests, social media publication, and related IP or publicity rights are described in the Privacy Policy (Photo & Video Release section). If you wish to revoke or modify prior consent, follow the procedure specified in the Privacy Policy.

13. Disruptive or Unsafe Conduct

Vinci may, in its reasonable discretion, suspend or dismiss (without refund) any student, parent/guardian, or guest whose conduct materially: (a) violates incorporated rules; (b) undermines safety; (c) disrupts instruction; or (d) impedes Vinci’s educational mission. Reinstatement, if any, is at Vinci’s sole discretion. Outstanding unpaid balances remain due per these Terms and any applicable Service-specific policy.

14. Non-Discrimination & Equal Opportunity

Vinci provides its educational programs, services, activities, and admissions on an equal opportunity basis. Discrimination, harassment, or retaliation based on (including but not limited to) race, color, ethnicity, national origin, citizenship, language, religion, creed, disability, medical condition, genetic information, sex, sexual orientation, gender identity or expression, age, marital or parental status, military or veteran status, or any other status protected by applicable federal, state, or local law is prohibited.

15. Acknowledgment of Review

Enrollment, attendance, or continued participation constitutes acknowledgment that you (and, where applicable, your child(ren)) have read, understood, and agree to all incorporated documents and updates posted. You are responsible for periodically reviewing updated versions. Material changes will be communicated consistent with the notice practices in the Privacy Policy.

16. Updates to These Terms

Vinci may update these Terms prospectively. The "Last updated" date will change upon revision. Continued participation after updates constitutes acceptance of the revised Terms. If you do not agree to updated Terms, you must provide written notice and discontinue participation before the effective date of changes.

17. Severability

If any provision of these Terms or an incorporated document is held invalid or unenforceable, the remaining provisions shall remain in full force and construed to give maximum effect to the intent of the parties and permissible scope of applicable law.

Warning: This agreement is legally binding. By signing it you give up your right to recover compensation through the courts or otherwise, for any personal injury, damage to your property, or for your or your child’s death, is caused by negligence, accident, or otherwise. Parent/legal guardian signature is required for participants under 18 years old.
